I believe using it is not illegal but it certainly is close. It's basically mass spam software that allows you to post your link on literally millions of forums. At first glance you might think this would help your website out but it might actually cause Google and other search engines to not only de-list your website from their indexes, but also ban you and put a negative reputation on your website. If I were you I would stay away and focus on marketing your site via social bookmarking, article marketing, video marketing, PPC etc.
Xrumer is not good good software because google always like manual work, because excess of everything is bad, it can only happen due to software.
Xrumer is generally for short term gains only, as is just about any black hat. It IS black hat 100% and although you do hear about occasional black hatted websites maintaining good ranking from it long term, for every one of those I see or hear about 50+ more that get de-indexed, penalised or banned. I guess it's up to every individual to decide whether it's worth it.
