    All songs are included with website.

    That's not the point. Especially with music. You cannot broadcast -- and in legal terms what you're doing on a website IS broadcasting -- without a license (meaning a license to use the content, not to broadcast). And without that license...just to legally use the content...you're technically in violation of the copyright.

    I've struggled with the use of music on my Christmas sites for years. Finally ended up going with a Live365 station for the simple fact that their licensing fees that I pay each month covers me on this issue. In your case, I don't see how you're covered.

    Far as I know if broadcasting was illegal, alot of webradios would be offline.
    I think we should save the legal issues for another thread.

    Alot of web radio IS offline because of this issue. This is a very relevant topic considering this site is for sale. I might consider buying it if I can be satisfied about the legalities involved in playing commercially available music. If you buy a CD and play it in your car, you've got a license to do so because you bought the CD and you're using it in a private space. The Internet is not a private space. In order to play commercially produced music you need a license to do so. Without it, your ISP or webhost could be sued. Would you want to be part of this?

    Shoutcast has proper licensing. I'm not seeing any kind of licensing on this site for sale.

    While you're legally right, who would question the content on a site like this? It is possible, but the buyer isn't risking much. Th RIAA and similar organizations have bigger fish to fry.

    Sorry to have been of trouble. I'd consider your site for my network if I could get this question answered. I manage more than 28 sites in this niche and I felt the question was legitimate for one considering purchase.

    I am also interested in a holiday-themes site. However, there is an interesting discussion going on here and I also have a bit of knowledge about the subject matter.

    These are right questions to ask if someone's buying your site because the music is in the core of the site's content, so be patient here. The questions may be rather easily answered by letting us know where and how you've got the music. Not all music has to be licensed although most of it is. Additionally, there are number of artists that would license music to you directly or through a second tier provider/broker. I can also imagine that you can rather easily get royalty-free Christmas music these days. No one is accusing you of copyright violations here and there is a legal way to run a site like this.

    So, can you simply tell where the music is from? PM if don't want it in the open, please.

    Can't really broadcast most of the titles over the Net then (assuming you are a U.S. entity. If not - may still be in trouble. Check with a local copyright attorney). Check on the back of CDs you got them from for a copyright notice - you'll see whom to expect a letter from ;) . In case you become big enough for them to bother that is.

    Still I am interested but your actual music's gotta go.

    Say, I bought my own royalty-free collection and acquired broadcast rights (which I'm not even sure feasible for Christmas music, but still...). Would the site still be useful? How difficult it is to add/delete links to other music files? Are you still interested in selling?
