50% or more CTR is possible using an ugly theme. As long as content is unique, there is no problem with google...

I agree with you, except that this particular theme is wrong because the title is just above the ads and so could be seen as labelling the ads.

Well, whatever really, I speak not from a myth but from an email I received from adsense representative giving me 72hours to comply otherwise my site would have ads disabled. But whatever really, it's fine like that since it's not mine!
If you'd like an advice it would be to add the tags between title and start of adsense/article, but doesn't sound like you want any advice, fine.

There is a word "advertisement" under the title before the ads and I think it's enough for you... The people who developed this theme are not just adsense nebies... They are running a couple of hundreds adsense niche sites since 2004...

1. privacy policy page and about page
2. unique content (non duplicate)
3. only 1 adsense block

Google does not ban sites just for ugly theme.. google ban sites for illegal clicks, duplicate content (when the original author complains), and and violation of TOS...

Tell me which TOS this theme violated....
