Hi, I wanted to develope my site
Azlyrics
Bought the site and database of another site. However I didn't manage to recover the database even with the help of the site owner.
Also I bought $20 hosting package for a year here on DP just for this site.
Altogether I paid around $10 or more for database and script plus $20(hosting) and a lot of my time.Also the domain is very logical.
I want to recoup some of my money at least.
The domain is extremely brandable and I believe they get traffic because the .com version is the most popular lyrics site in Alexa.

The zip database is 200MB, extracted it and uploaded via SSH recover for cpanel but the songs cannot display. Only group names and songs. See the site

purchasing this domain and using it would constitute 'Bad Faith' under ICANN's UDRP policy. This means that you are knowingly infringing on Azlyrics.com's trademark with the intention of purposefully confusing consumers and ICANN will simply take your domain and send it to them.

I thought it was only considered "bad faith" if you tried to sell the domain to the .com owner, with the intention to profit from it? People buy various extentions of well known .coms all the time.

 

nope. that is plain trademark infringement right there.

example, if you are using google.info as a search engine BAM you lose the UDRP claim.

you could buy that domain and use it as a landing page with relatively fewer problems as long as you didnt sell links to competiting lyric sites.

 

Its only trademark infringemark if there's a trademark registered, which in many case there isnt. People may THINK there is, but that isnt always true. I went through that battle a few months ago.

 

I own a copy of the script so I guess I can sell it to you my copy as I don't need it. Just make sure you only use it for just one of your domain.

that is actually false. there is a common law trademark attached to domains that protects the use of a domain for single purpose as long as the domain filing the claim has been using it for said purpose for a certain lenth of time (fairly undefined but usually a 6-12 month period is the minimum)

and since domains are int'l ICANN issued the UDRP to handle many such claims. Others would fall under the int'l TRIPS agreement and yes using this domain to damage the business of, or confuse the business with AZLyrics.com is a violation of both.
