I have a site http://youtube.me.uk registered with Dyna Dot for 2 years.

It have a script which grab videos from youtube and show them on our site. Website don't take much space and bandwidth.

There is also a search engine where you can search videos.

You will get complete site with domain name.

This is a brand new site and have low traffic and revenue.

Does this breach their copyright at all? Using their name and I think that is their logo?

 

Your site is blatant trademark infringement. You should remove all videos and the ripoff of the youtube logo before you get sued.

This domain is purely an infringement of trademark rights. I don't think that it is a wise thing to go with it.

After considering all the above opinions i have changed the logo. The domain is legally owned by me. It is registered by ICANN so nobody can claim on the domain name.

The videos are not being ripped there is a service of google adsense which provides you tube videos to show on publishers website.


There is nothing illegal in the development and ownership of this site.

So Guys there is nothing to worry about!

 

But YouTube is a trademark, so there is a lot to worry about. Logo or no logo.

 

LOL, If you keep thinking that, then you are in for a big surprise. "Youtube" is copyrighted and trademarked to Google, so therefore they can seize it at any time they damn well want

You can put videos on a site. What you can't do is use a trademark like "youtube" in your domain when the usage is similar or in the classification as the trademark holder.

Your usage of the domain is positively trademark infringement. There is no question about this.

ICANN can, and will take the name from you and turn it over to the trademark holder. Read the terms when you registered the domain. A UDRP arbitration can take the domain in about 2 months or less. Of course the trademark holder may decide to sue you. As youtube is a Federally registered trademark, they can also be awarded treble their legal fees, plus damages. You're talking about tens of thousands, possibly hundreds of thousands of dollars if it goes through court - this is in addition to your own legal fees.

Give any intellectual property rights attorney a call. This case is so blatant that they can likely advise you what to do with little or no research.

 

Just google "UDRP", then come back and delete your thread.

At least I say you can't compete in the same market with them. Meaning streaming videos.

 

But what could you do, I don't think you could find a purpose for the domain now and this thread on its own proves he is aware of youtube and could be used to show bad faith.

 

As crude and bad as this sounds, I would list it on Sedo, Afternic, or Snapnames with a low bid. Or just let it expire for some other newbie to reg.

the name "youtube" is a trademark.. to have that name in your domain is against TOS. It's almost like opening a restaurant/takeaway and calling it mcdonalds.me and selling the same kinda stuff as mcdonalds.
