On Google my site "libertybell.biz" has below an site (notime4school.com) with a similiar title tag and is listed as having a virus warning that the site "may harm your computer".

I believe the site may be having a negative impact on my website with visitor confusion, maby they will visit his site instead and mistake it for mine.

Is there anything I can do to get that site out of there? I know this not probably a legal question per say. But this is problem for my site. I need that site out of there!
So far I've contacted the owner although have doubts that will do anything.

The problem with this site is the page actually doesn't exist that is advertising my site in the serp. But is still responds with 200 found and returns the index the index.php with the same url. So the page will not be removed by Google.

You need to contact that guy and tell him to get rid of that message by removing adware from his site.

Well I have contacted him. But I doubt they will respond. Would contacted his host be a good idea for a next course of action?

If it really comes down to it. I will push site down with SEOing some other pages to get it pushed down but that takes alot work.

It will soon die off anyway with that warning less users will visit so it will loose its rank, just make a blog or something along with your site under a subdomain or something and blog, you will soon take up a couple more spots
