can I get new addsense account if my first account is banned

    LOL.. oh I don't know about how much to setup a company there.

    I knew many people just like me do adsense for fun and earn for candy. (might be a giant packs) and don't want to set up a company.

    Personally I won't setup company because too much about paper, tax and messy stuff here.

    But if you set up a company, and apply for adsense, and get approved.
    You can still get banned.
    There is no law that says because it is a company, that google has to honor the fact that the company was approved.
    There are dishonest companies as much as dishonest people.

    So just the fact that you set up a company does not mean you are not liable for the company actions.

    Agree but you missed my point in relation to this particular scenario. The guy has been banned, his only hope is to set up a company. (or use a third party). While your 100% correct that the new entity can get banned, what I was saying was that the new entity can not get banned because this guy is a director. Once accepted, closing an account because of a material fact available at the time of acceptnce is a legal nightmare, and I very mushch doubt G would risk this.

    That said, if this dude has got himself banned once, and is now looking for a cheat around, then chances are he will get himself banned again ;)

    I wouldn't worry too much. If you follow TOS and your account gets banned, you can work with Google. Most people post on here that Google "banned my account for no reason!" But, normally by the end of the thread, they admit to breaking some aspect of the TOS. If you have nothing to hide, you should be OK.

    Do you think google is worried that some company will sue them if they get banned because one or more of the directors of said company were banned previously by google?

    It is a material fact that was available at time of application that the director was banned.
    But that does not mean legally that google can not ban the company when they do find out later that they accepted a company with a banned director.

    Again, I see that anyone who gets banned by google that wants a work around, had best check with a lawyer before setting up a company just to get accepted by google to show adsense.

    Here's what you do

    1) Set up an LLC, which in most states is under $100
    2) Get an employer tax id number, which is like a social security number for your company
    3) Apply for adsense
    4) Get accepted
    5) Don't screw up or you'll have to set up a new company

    You should be doing this already to get all of the tax benefits that you can. And I would also talk to a certifiied public accountant about taking all of your write-offs that are legally yours and how to set up your office/accounting/company.

    Yep I hear what your saying, here is the thing though a company is a separate legal entity, and as such has to banned under its own rights. Google are unlikely to risk getting involved in what might be a precident setting case. If I open up a ltd company, and my fellow director has had his account terminated, why should I be punished? I have done no wrong. The company will have done no wrong.

    Anyhow this is all academic really as I know MANY people who are earning a LOT of money through adsense/affiliate, and this is how they handle it. Multiple accounts through legal entities.

    Being a NEW You can help. It sounds difficult but possible
    1st Find a new email address.
    2nd Use another name (Like your cousin , dad , mom , friend etc.)
    3rd Apply for Blogger account , Look for and Post GREAT Articles.
    Doing this for a week and use Adsense option in blogger , you MAY get a new adsense account !!

    The easiest way , mail google , describe your situation for reinstate you in adsense again.

    If you're honestly i wish you good luck

    There is no way Google can approved or reinstated your Adsense account ones your have being banned. I've the experiance with banned Adsense account with no reason whatsoever. The Google said that I've click my own account many time but no way I do that whatsoever. I've found that one of my competitor has clicked my Adsense many times from the same PC.

    It's because Google detect your IP Address, MAC Address, Tracking Cookies and many others technique.

    After about 3 month dealing with Google team using personal letters and phone call, still they didn't reinstated my account. For them if my account reinstated, this competitor will still frauding the system.

    I don't blame Google for this (they have stated it in TOS) but rather than the competitor that abuse the system Google has set up. I've found that anyone can abuse the fraud management system that Google use to monitor the Adsense click.

    There is no way you or Google can overcome this because no one knows what is the real "click client". Google see that if the click is single (unique) ones, than it's a real client but if the click is double or triple time it's a fraud client.

    So what to monitor and differentiate? It's up to the Google instead.
