Not according to forensic medicine. Plus the parallel you have drawn is wrong. You can control getting drunk, you cannot always control sleepwalking and your actions during that state.

 

First thing first. I cannot take this case seriously. When reading through this part:

Now, it says that it was a sleepover, which includes that there were other girls in that room with this girl. They should have been all around the same age as this 15 yr old. I would need someone to tell me how a sleepwalker can walk into the house and go past these girls, waking up none of them and then having sex and fondling one of the girls?

Edit: Another thing, you girls keep thinking that it always the guy's fault. Personally talking through all the crap I've seen on news, if this guy really did rape this girl, then he would have gotten jail time, no matter what his excuse is. But he didn't get ANY jail time or fine. I'm pretty sure that there was consent from the girl in his action.

Regardless if he knew or remembered his actions he should be held responsible in some way.

If he knew he had a history of sleep walking he needs to cuff his pecker to the bed post.
