Does Islam forbid men from marrying prepubescent girls?

    :mad:Does Islam forbid men from marrying prepubescent girls? The answer is NO.

    I was challenged by someone in another thread to show proofs that Islam authorises men to marry under-aged girls (pre-puberty) and erotically enjoying them.

    Before I list the evidence, I’d like to point out that this practice is not common in most Islamic countriers, however there are known and occurring incidents that are still happening in our days.

    List of some evidence:

    1-First l must point out that the prophet Muhammed himself and in his fifties married a young girl at 6 or 7 of age and had intercourse with her at the age of 9.

    3- Never mind Khamenei, how about al-Sistani? Let’s see what he says:
    This information is from his book on his official website

    "Question 8: It is not permissible to have a sexual intercourse with the wife before completing the age of 9. Continuous be it or interrupted marriage, however in regards to other enjoyments such as touching with pleasure, kissing, hugging and to thigh the girl is acceptable . Even if he had sexual intercourse before completing the age of 9 and did not deflower her, then there shall be no obligation on his part other than committing an offence at best."​

    To 'thigh' meaning to place the male member between the young girl thighs.
    Touching with pleasure meaning erotic touches.

    This is the closes translation that I could come up with. Ask any Arabic speaker and they’ll tell you just that.

    al-Sistani is a Grand Ayatollah which is a high ranking title given to Shi'a clerics. Those who carry the title Ayatollah are experts in Islamic studies.

    Al sistani did not invent this ruling, the fatwa has long Islamic tradition and solid bases.

    3-The Majority of sunnis may not agree with the shi'a, but they too do not forbid the under age marriage nor do they denounce the sexual relationship with the young wife, provided that no penetration is performed prior the puberty.

    This Fatwah sums it up:

    Question: "My parents married me to a young girl and they have warned not to touch her, what the Islamic law say about this?


    Reply: If the girl is too young to perform sexual intercourse then it is not permissible to penetrate because that would harm her…. However it is tolerable to touch her, hug her, kiss her and ejaculate between her legs. But the anus must be avoided because it is haram​

    4-What happens in practice?

    In interview with alarabiya TV, Ghada Jamshir a Bahraini women's rights activist said the following about violation of children’s rights in her country

    Also If you know someone who knows Arabic ask them to explain this to you. The shi'a in this book tries to prove to the sunni that this practice is shared among the two and that It should be ok for them.

    I don't get what people are trying to prove with these topics..seriously, everyone has there own culture, don't try and prove yours is any better.

    I guess it depends on what you consider as the hatred.

    Some people would say having sex with a nine year old is the hatred. Others might suggest that being aware of it, is the hatred.

    but you only based yourself on what some scholars have decided, any scholar can make up a fatwa if they want you. where are the proofs from the Koran? hadiths? did the phrophet do it? did he say we could do it? some people misterpret everything, even for stonning they are conditions.

    alaska88, I know where your coming from, but as for the "did the phrophet do it? did he say we could do it?" comment, yes he did as shown by the evidence, as if he did it and is supposed to be a example, why wouldn't it be allowed for anyone else?

    Islam forbits that is un-natural , do you believe that a religion that has this much followers can accept the evil thing you mention.
    Hz A'isha the wife of the Prophet was 17 when they married.

    No. They did marry at an early age ie 9. BUT on the order of God. But Aisha never mentioned they ever entered into a physical relationship, nor did they have any child. And furthermore, Aisha spent all her life teaching people about the wonderful character of Prophet Muhammad (PBUH). That leaves nothing else to discuss.
    Kafer is just calling God to punish him.

    Do you think these scholars are making this up?

    The Hadith states that the prophet married a child at the age of 6 or 7.
    The Quran [65:4] talks about some divorce laws and included “those who have it not” means married women who did not have their period yet.

    Just with the above 2 evidence one will have no choice but to conclude that a man is allowed to marry pre-puberty girls.

    Where is the girl’s consent in this type of marriages?

    How can a girl physically or mentally be ready for such abuse?

    How can a girl, one day after her first period be subjected to full intercourse?

    Just imagine a man at 53 desiring a girl 7 years of age to want to marry her? What kind of standard was your prophet setting here?

    It’s also not haram to enjoy the under-aged wife sexually. Just ask your imams if you have any?

    You are defending the un-defendable. The actions of your prophet are shameful, shameful, shameful.

    I’ve left this evil just on time, and there shall be return.
