Just a quick update guys, I redirected my site from www.richjerkscams.com to www.circlejerkclan.com running on the same server using a 301 redirect, now I'm just waiting for google to recognize the move. Apparently it takes some time before I get back the rankings. We'll see. Good case study for 301 redirects. I'll update if anything else interesting happens.

Just an update, Google has listed www.circlejerkclan.com back at No.3 position. Google took all of 3 days to recognize the 301 redirect and I'm hoping it'll stay there for time to come. Cross my fingers. Anyway, I suppose if my rankings do stay then it does prove that doing a 301 redirect to another domain really is a very simple exercise with almost no loss in SERPs.
Personally, I don't like richjerk - sounds like a scam! But your violating his rights! He can collect any money you've made from it from day one. The problem for him is that he must prove that you have. Suggest you keep bad records.

This is total and outer BS. You can only fight for a TM if the TM name can in no way be a logical word or word combination. For example: Nintendo is a fightable TM because the word "Nintendo" can in no way be used other then for their product, this is clearly not the case for the words "Rich Jerk" wich can be used in about two million ways. Let him fight, he is probably just hoping you give up without the fight because he knows he can't win this. To Rich Jerk if you read this: this is what you get for using normal English vocabulary words to TM yourself.
He can't do anything to you but offer to buy out your domain. If he didn't get to it first, his loss!!! He's just trying to scare you... you can go on a legal forum to get more info. I'd have an attorney write up a letter for you to send back, if they sent one letter I doubt this will be their last. Good luck!!! Don't give up!!!!
That simply isn't true. RichJerk could sue for trademark infringement, and companies have simply been handed domains that have determined infringe their trademark. It's definitely good advice to consult an attorney with expertise in trademark law.
I don't believe this is true. If you owned the staples.com domain before Staples.com bought it... they would have to pay you for it. So why would it be any different for some unknown guy who calls himself rich jerk? You can sue someone for anything, it's whether or not you have any ground in court that counts. You know?
The problem is that the anti-cybersquatting act specifically grants this power to companies and celebrities. If someone is profiting off of their copyright, then they have the full right to the domain and all profits from it. Now if staples.com was just an honest site about staples and staplers, then the owner would be in the right. A perfect example is Nissan.com. That guy fought and won his case (I think that he won by now) because his last name was Nissan and he wasn't infringing on their copyright. If this guy did a site about rich jerks in general he would be fine, but he is discussing the richjerk e-book and therefore he is profiting off of the rich jerk's copyright. Besides, changing the name turned out to be pretty easy.
