Ask him to transfer it to you, what registrar are you using?

Ask for the EPP code (auth code) and transfer to some registrars. It's easier to control your domains.

Oh my god....I am having the exact same problem and came here for suggestions. Its been over 3 weeks with no response and the only way the registrar will transfer into my name is for the resller to give me a transfer code. It has been hell. I cotnacted ICANN and they have also not replied. (and no I dont have spam filters on ;) The reseller is still "paying" their bills so they wont hange for that reason either. Names (4) ever is the reg and one hut. (com) is the host. Stay AWAY!!
The only way from now on is to always buy from an ICANN registrar so it is definitly in your name.
Any help would be appreciated.
Thanks,

in Whois information . what is administrator email ?
what is LOCEKD/UNLOCKED status ?
if you domain is Unlock and your email set as administrator email .
you can send a transfer request and verify it by your email .

This is the number one reason why people should be wary who they register
their domain names with. Once in, it's hard to get out unscathed.
You can seek ICANN, the BBB, or even your state Attorney General if you do
have one. But none of them can guarantee you'll be able to get the domain
name back.
Short of seeking legal advice, your only option is to persist with the provider.
Email, ticket, call, use any available means of contact.
