As is the case with the majority of people who participate in this forum, I use DP's KWT daily and decided to create a similar tool that checks Google, Yahoo, and MSN more or less to prove to myself I could do it. But as I get further into its development, I'm faced with the possibility that it may become popular so I decided to look into the legalities of it.

No Automated Querying

You may not send automated queries of any sort to Google's system without express permission in advance from Google. Note that "sending automated queries" includes, among other things:

* using any software which sends queries to Google to determine how a website or webpage "ranks" on Google for various queries;
* "meta-searching" Google; and
* performing "offline" searches on Google.

[From: http://www.google.com/intl/en/terms_of_service.html]

Does this mean I need to write Google and ask their permission? If so, what are the odds that they will grant the permission?

(Sorry if I asked a stupid question, but I've never been very fluent in legalese.)

If you use the API you'll have no problems at all. However that is limited to 1000 queries a day.

This brings up the question: why is it "legal" to use their API in ways it violates Google's TOS?
